Terms of Service

1. Agreement
By creating an account or using Cadence, you agree to these Terms of Service. If you do not agree, do not use the app.
2. Who we are
Cadence is operated by Dinesh Dawonauth, based in Toronto, Ontario, Canada.
3. Eligibility
You must be at least 16 years old to use Cadence. By creating an account, you confirm that you meet this requirement. If we learn that someone under 16 has created an account, we will delete it.
4. Your account
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when creating your account.

5. What Cadence provides
Cadence is a cycle tracking app that lets you:
- Log period flow, mood, energy, symptoms, sleep, intimacy, and notes
- View cycle predictions based on your logged data
- Share selected health data with a connected partner
- Receive optional push notifications about your cycle
6. Not medical advice
Cadence is not a medical device. It is not a diagnostic tool. Cycle predictions, phase calculations, and fertile window estimates are based on statistical averages and your logged data — they are not medical advice.
Do not use Cadence as a substitute for professional medical care. Do not rely on Cadence for contraception or fertility planning. Always consult a qualified healthcare provider for medical decisions related to your health.
7. Partner sharing
When you connect with a partner through Cadence, you control what health data they can see. Nothing is shared by default — you choose which categories to enable.
By connecting with a partner, you consent to them viewing the categories you have enabled. Your partner cannot see categories you have not enabled, and can never see intimacy, sleep, or note data regardless of your settings.
Either partner can disconnect at any time. Disconnection permanently deletes all shared data for that connection.
8. Your data
You own your health data. Cadence processes it to provide the service described in these terms. We do not claim ownership of any data you create in the app. For details on how we collect, use, and protect your data, see our Privacy Policy.
9. Acceptable use
You agree not to:
- Use Cadence to harass, stalk, or monitor another person without their consent
- Attempt to access another user's data or account
- Reverse engineer, decompile, or disassemble the app
- Use automated tools to scrape or extract data from the service
- Misrepresent your identity or create accounts for others
- Use the service for any unlawful purpose
10. Intellectual property
The Cadence app, its design, brand, and content are owned by Dinesh Dawonauth. You may not copy, modify, or distribute any part of the app without permission. Your use of the app does not grant you any ownership rights in the service or its content.
11. Account termination
You may stop using Cadence at any time. To delete your account and all associated data, email privacy@dineshd.dev. We will process your request within 30 days.
We reserve the right to suspend or terminate accounts that violate these terms. If we terminate your account, we will delete your data in accordance with our Privacy Policy.
12. Disclaimers
Cadence is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:
- The service will be uninterrupted or error-free
- Cycle predictions will be accurate
- The app will meet your specific requirements
To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of liability
To the fullest extent permitted by applicable law, Dinesh Dawonauth shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Cadence, including but not limited to reliance on cycle predictions or health data.
Total liability for any claim related to the service shall not exceed the amount you paid for the service in the 12 months preceding the claim.
14. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms or your use of Cadence shall be resolved in the courts of Ontario.
15. Dispute resolution
Before initiating any formal proceeding, you agree to contact us at privacy@dineshd.dev and attempt to resolve the dispute informally for at least 30 days.
16. Changes to these terms
We may update these terms from time to time. When we make material changes, we will update the date at the top of this page and notify you through the app. Continued use of Cadence after changes take effect constitutes acceptance of the updated terms.
